Am I Eligible To Claim Divorced Spousal Benefits From My Former Husband?

I started taking my Soc Sec at age 64. Now at age 70, I wonder if I am eligible to claim divorced survivor benefits from my former husband who recently passed away. His earning were greater than mine, and we were married for 26yrs. Thanks!

Hi,

Possibly, but you could only qualify for surviving divorced spousal benefits if you're unmarried or if your current marriage occurred after you reached age 60. Your potential benefit rate as a surviving divorced spouse would depend on a number of factors, such as whether or not your ex-spouse collected reduced Social Security retirement benefits prior to his death. Assuming that you meet the requirements (https://www.ssa.gov/OP_Home/handbook/handbook.04/handbook-0403.html), you'll probably want to get in touch with Social Security as soon as possible to see about filing for benefits.

Best, Jerry
