Will My Children's Back Pay Be 50% Of The Back Pay I Received?

Hi Larry I was awarded SSDI earlier this year. My children have been approved to receive benefits as well including back pay for the time I didnt work. Is that usually 50% of the backpay I received? I have 2 kids. Could you give me an example? Thank you very much.

Hi,

The benefit rate that can be paid to an eligible auxiliaries (e.g. child) on the record of a person receiving Social Security disability (SSDI) benefits can range from as little as zero dollars to as much as 50% of the SSDI recipient's full benefit rate. That's because the family . . . Read More

Can A Person Withdraw An Application For Social Security Disability Benefits At Any Time?

Thank you very much for providing FREE service to the community. Can a person withdraw an application for Social Security Disability during an application process and/or after the person has been approved for disability? Any deadlines for withdrawal? Should a form SSA-521 to be used to initiate the withdrawl (whether a person withdrawing before or after the approval)? After the withdrawal -- can the application for Social Security disability be reinstated, if my circumstances have changed? Thank you

Why Did My Wife And I Receive An Extra Deposit This Month?

Social deposited $114.00 in my wifes name and $327.00 in my name on October 19th , 2020 what was this for?

Hi,

There are a number of reasons why you may have received an extra payment from Social Security. It's likely an adjustment payment of some sort, and the most common types of adjustments are caused by automated recomputations to include additional earnings.

Social Security retirement benefits are based on an average of a person's highest 35 years of Social Security covered wage-indexed earnings. If a person is already drawing their . . . Read More

Can My Wife Draw Off Of My SS, And How Much Could She Draw?

My wife has been on SS disability for several years and draws a modest $614 per month. She didn't have an extensive work career. I am 65 and have been drawing my SS for almost a year. My draw is $2327 per month. She will turn 62 in December of 2020. Can she draw off of my SS, and if so, what would she qualify for? Thanks, Wayne

Hi Wayne,

Yes, it sounds like at age 62 your wife could qualify for an excess spousal benefit in addition to her Social Security disability (SSDI) benefit, but if she claims her spousal benefits prior to her full retirement age . . . Read More

Can My Wife Apply And Receive A Spousal Benefit Equal To 50% Of My Current SS Payment?

I receive SS now at 84, applied at normal age. My wife, 72 born 4/17/49 applied and receives SS at early age. Can my wife apply and receive spousal benefit at 50% of my current rate of SS payment?
Thank you

Hi,

No. If your wife started drawing her benefits prior to full retirement age (FRA), the reduction for age that was applied to her benefit rate will continue for as long as both of you are living. Your wife could apply for spousal benefits to be paid in addition to her own benefits, but she'll only qualify if 50% of your primary insurance . . . Read More

Will My Son Receive My Total FMB If He Qualifies As A DAC?

I wrote to you 9/15/2020 concerning getting my disabled adult child benefits on my SS. He is 42 and started receiving benefits on his own record at 28. His present benefit is $790. plus he receive a small amt from SSI. Now I am receiving my SS benefits and since he was disabled as a child, I figured it was worth trying to get him DAC to increase his benefit. Since his original determination considered his disability onset when he applied at age 28, SS told me he was not elegible for DAC benefits--on more than one occasion. THANKS TO YOU, I pointed out your reply to me and he . . . Read More

Would Social Security Contact Me For More Information After I Submit My Online Disability Claim?

Due to COVID I can only apply for social security disability using on-line form. It does not appear that the on-line form allows adding additional page to the remarks section. I have seen a lot of doctors about 12 regarding my illnesses and would quickly run out out of allotted space on this on-line form. Would Social Security contact me after I submit the application to obtain the additional doctor's names? Can I also somehow submit medical records myself (as I have them from my personal injury claim) to SSA -- as I understand that often SSA gives up on getting the medical . . . Read More

May I Keep You Posted?

Hi Larry,

Just earlier this week you were nice enough to quickly respond to my following question: Is Social Security just forgetting the January 2, 1954 rule for spousal benefits??!

I wanted to give you an update that we escalated to a supervisor who advised us that affective in 2018 the Social Security administration is allowing this claiming strategy for anyone reaching full retirement age in 2020, regardless of birthday. He went on to explain that we would not find it online but internally, the system is set up to support this change. We requested some form of . . . Read More

Do I Have To Continue Working Between My FRA And Age 70 To Be Eligible For Delayed Retirement Credits?

Do I have to continue working between my FRA and my 70 DOB to be eligible for Delayed Retirement Credits? Thanks!

Hi,

No. You can accrue delayed retirement credits (DRC) from full retirement age (FRA) until age 70 whether you are working during that time or not.

Best, Jerry
