Can My Granddaughter Get Social Security If We Have Legal Guardianship Of Her?

Me and my husband have legal guardianship over our granddaughter and he gets social security can she get a check

Hi,

The mere fact that you have legal guardianship of your granddaughter wouldn't make her eligible for child's benefits on your husband's Social Security record. In order for a grandchild to qualify for benefits on the record of a grandparent, the grandchild must either a) be adopted by the grandparent, or b) both of the grandchild's natural or adoptive parents must either be deceased or disabled (https://www.ssa.gov/OP_Home/handbook/handbook.03/handbook-0325.html).

Best, Jerry
