My wife passed away, she has received one extra check from the treasury for her Ssa benefits .o have spoke to the bank and Ssa about the over payment! Ssa says the treasury is the one to take he overage back. Our bank won’t let me draw out the balance of over payment!!! HOW do I get your money out of the bank??

Social Security is correct that the U.S. Treasury department is responsible for reclaiming any Social Security benefits that were incorrectly deposited to your wife's bank account. However, I'm not an expert on banking regulations so I don't know what rights you have regarding making withdrawals from your wife's bank account. In any case, though, if a Social Security benefit payment was directly deposited in your wife's account for the month of her death, then that amount will need to be reclaimed by the Treasury department and returned to the Social Security trust fund.
To clarify the Social Security regulations regarding payments received after a person's death, no benefits are payable for the calendar month in which a person dies. But, Social Security benefits are paid a month behind. So, for example, if a person dies in November 2021, then their regular monthly payment for November that arrives in December would need to be returned.
