If My Husband Gets Disability Benefits, Can I File For Spousal Benefits Only On His Record?

I am 67 and retired but have not filed for my social security. I was planning on filing when I reached 70 if possible. My husband is 59. He recently recived a medical retirement and was told by his lawyer that he should now apply to social security for disability. If he gets on SS disability would I be entitled to collect off his disability benefit till I reach 70 and collect off my own? Our benefit at PIA are similar.

Thanks for your wonderful column.

Hi,

Yes, if your husband is approved for disability benefits, you'll want to file a restricted application for spousal benefits only. You can then let your own benefit rate grow until age 70.

There is a less generous family maximum formula that applies to auxiliary benefits payable on the account of a disabled worker, but that shouldn't affect you as long as your husband's PIA is at least around $1200.

Best, Jerry
