Ask Larry

Would I Qualify For Higher Benefits On My New Spouse's Record If I Remarry?

If I remarry after the age of 67 am I eligible for SS benefits based on my 2nd spouses benefit(s) or earnings which are higher than benefits based on my former spouse's earnings.

Hi,

Potentially, yes (https://www.ssa.gov/planners/retire/applying6.html). However, unless you are already drawing benefits on a former spouse's record, you would not be eligible for spousal benefits on your new spouse's record until you have been married for 1 year.

Best, Jerry
