I was married for 40years. I had to start taking SS at age 62 to take care of my husband. My husband started SS at 65. He then passed away three years later. He was at a much higher payment than i. So it was reduced bc, I had to take it before I wanted to. What really doesn't make sense is my sister was able to draw off of her first husband that she divorced when her second husband died. I think the SS should make it fair for someone who should be drawing a spouse's SS.

I'm sorry for your loss.

I agree that some of Social Security's rules seem unfair, but there's nothing I can do about that. Only Congress has the power to amend the Social Security law and regulations.

If you were drawing your own Social Security benefits when your husband died and you are now receiving a higher amount from his record, then it sounds like you're probably getting the most that you're eligible for from Social Security. I don't have enough information, though, to know if you had any other filing options.
