I have a 31year old adult disabled daughter receiving both SSI an SSDI (on her own work record). Her father will be filing for Social Security Retirement Benefits soon. When her father files for SS Retirement Benefits we can also file an application for (Child's Insurance Benefits) based on his work record. As a result she is entitled to benefits on more then one earnings record (her own and her fathers). I also know she would not collect the maximum amount on both earnings records. She would collect the higher of the two and she would also not collect SSI anymore. My question is...... when we file for Childhood Disability Benefits (CDB) will SS require also require us to file form SSA 3368 (Disability Adult Report) again? She has already been determined she is disabled by SS prior to age 22 and within the last year just went through a Redetermination (full medical review) as periodically required by law for anyone who is on disability and was found that her disability is continuing.
Hi. Probably not. As long as your daughter's date of disability onset was established prior to age 22 for Supplemental Security Income (SSI) and/or Social Security disability (SSDI) benefits, and assuming that she hasn't done any work since that time that Social Security would classify as substantial gainful activity (SGA), then Social Security should be able to adopt the previous medical determination for disabled adult child's benefits.
It sounds like you have a number of potential filing options, so you may want to strongly consider using our software (https://maximizemysocialsecurity.com/purchase) to fully analyze the options available to you and your family in order to determine your best strategy for maximizing your benefits.
