Can I Apply For Benefits From My Husband?

My husband and I were both born in 53. We both took Social Security at age 62. Can I apply for benefits from him?

Hi. You can certainly apply for spousal benefits, but I can't tell you whether or not your qualify for them. Assuming that your husband is still living, you'll only qualify for spousal benefits if your own primary insurance amount (PIA) is less than 50% of your husband's PIA. A person's PIA is equal to their Social Security retirement benefit rate if they start drawing their benefits at full retirement age (FRA).

Hi. I'm sorry for your loss. I see no reason to think that your mother has anything to worry about with regard to her benefits. If your mother has been receiving benefits as a divorced spouse, then her divorced spousal rate should go up as a surviving ex-spouse.

Can my disability SSI be deducted from the disability pension from the company. My disability SSI is being deducted by the company disability pension is that not unconstitutional and arbitrary.

Is It Common To Have A Discrepancy In My SSDI And FRA Benefit Rates?

I have been collecting SSDI on my own record since 3/1996 at age 36. I am also receiving 60% of my original private retirement amount under a disability plan I purchased and paid for thru my employer. I am now 62 and I know that my SSDI would be converted at my retirement age of 66 years and 10 months, full retirement age. However, there is a reduction in my FRA payment amount from SSA since I have been receiving cost of living increases annually on my SSDI. I took SS at 70, $2500, If i die does my spouse receive my $2500 benefit or my benefit @ my 66 year old rate? My wife took hers @66 as is receiving $1300

Hi. Yes, since your wife has reached full retirement age (FRA) for widow's benefits, if you die before her she'll be eligible for your full higher benefit rate. Technically Social Security would continue to pay your wife her own benefits plus a partial widow's benefit equal to the difference in your benefit rates, but the combined benefit amount would add up to your full age 70 rate.

Can You Verify The Accuracy Of An Article I Read?

Can you verify the accuracy of this article. The article states that once you achieve Full Retirement Age you no longer are required to pay any income tax on your social security earnings regardless of how much you earn or receive from pensions, IRAs, etc. To my knowledge this is not true, but has there been a change to the Social Security income taxation rules? I thought that you had to be aware that there is a potential that your Social Security could always be subject to the 50%/85% taxation even after reaching Full Retirement Age.
