Do I Have Any Rights To Pursue The Benefits That My Child Should Have Been Paid?
Hi Sir! I was "awarded" disability in 2006; my attorney and SSA never informed me of auxiliary benefits. I had a twelve year old at that time. I went from making nearly $2000.00 per week in 2002 to a failure in health and eventually receiving disability benefits in 2006. Although there were notations in both my medical records and my attorneys records of my child; I was never informed of auxiliary benefits I calculate the losses at almost $40,000.
Our credit was adversely affected during this time because we could not meet our obligations. This would not have happened if . . . Read More

Can My Husband Claim His Social Security In January And Still Receive The Six Month Retroactive Lump Sum?
I am collecting my Social Security and my husband is collecting spousal benefits. He will turn 70 in July, 2020. We do not want to increase our income this year due to tax reasons and Medicare IRMAA income limits. Collecting his full Social Security for half of this year would put us over the income limit for IRMAA and force us to pay the Medicare surcharge in 2022. Can he claim his full Social Security in January and still receive the six month retroactive lump sum benefit amount even though he will be collecting spousal benefits during those same six months from July-December . . . How Would WEP & GPO Be Applied In Our Case Since Half Of My Wife's Non-Covered Pension Is Paid In My Name?
Non-Covered Pension - WEP/GPO
Hi, I have a complicated situation and would appreciate your help. Here are the facts:
1) My wife and I divorced 9 years ago
2) As part of the divorce settlement, my wife’s Massachusetts county pension was split evenly such that we each received and continue to receive ½ the monthly benefit and each get a separate statement for tax purposes. The Domestic Relations Order (DRO) issued by the judge in our divorce says “For purposes of Section 72 and 402(a)(9) of the Internal Revenue Code, the Alternate Payee shall be treated as the . . . Will I Be Penalized For Months That I Receive Three Paychecks Instead Of Two?
I got paid bi-weekly so there are some months with three paychecks instead of 2. Am I penalized for months that went above the threshold of $910 per month (during the trial work period)
Hi,
When establishing trial work months Social Security counts earnings in the month they are earned, not when they are paid. However, evidence needed to establish precise monthly earnings is frequently unavailable to Social Security, so they often simply use the monthly earnings figures furnished by the person's employer. And, those reports usually show the amounts . . . Read More

Could My Husband Get Social Security For Our Grandson Who Lives With Us?
If my husband and I have legal and permanent custody of our grandson since 2014 and he's 10 years old, could my husband get social security for our grandson who has been living with us for 8 years? Do we have to adopt him or is having legal and permanent custody is good enough to have for him to receive the social security benefits.
Hi,
Grandchildren can only qualify for child's benefits on the record of a grandparent if they are either a) adopted by the grandparent, or b) if both of the grandchild's natural parents are either deceased or disabled. . . . Read More

Am I Correct In My Understanding Of How My Benefit Amount Would Be Calculated If I File At Age 62?
I hope I can make my inquiry understood, it's a bit confusing hence my questions.
1. Am I right in understanding that when I apply for benefits at 62, I will receive the larger of either my own benefit amount, or half of my husband's benefit, minus 30% for either option since I will be retiring before FRA?
2. Will the calculation include the delayed retirement credits he earned, or will it be based on his primary amount without allowing for the credits?
3. If I survive him, will I receive the entire amount he receives, including delayed credits, and will I . . . Read More

Will My Wife Benefit If I Wait Until Age 70?
My wife and I are the same age (58). She has mostly been a stay at home mom and has earned very little towards Social Security. I have a government pension that dies with me. I want to maximize her social security benefit. Will she benefit If I wait until 70? Must she wait until 70 to receive the maximum benefit from me? Thanks!
Hi,
Yes, your wife would be eligible for a higher survivor rate if you wait until age 70 to start drawing your benefits, and, no, she doesn't need to wait until she's age 70 to qualify for a full unreduced widow's rate. Widow . . . Read More

Doesn't Social Security Owe Me Back Payments To 2018?
I applied for benefits in 2018. Social Security lost my paperwork about 3 times and misled me into applying for spousal benefits, which was ultimately denied. Doesn't Social Security owe me back payments all the way back to 2018 when I originally applied? It is not my fault that Social Security lost my paperwork and forced me to go through the lengthy spousal benefits process. Please send me the link to where I should pick up your answer. Thank you so much!
Hi,
I can't answer your question because I have no way of knowing whether or not you qualified . . . Read More

Can I Apply For Unemployment While Being On SSDI?
I am on SSDI but work under the table babysitting for about $600 a month. I lost the babysitting job due to covid. Can I apply for UI/ pandemic unemployment while being on SSDI? and how do I go about doing it?
Hi,
Drawing unemployment benefits wouldn't have any effect on your Social Security disability (SSDI) benefits, but I'd be surprised if you qualify for unemployment if you haven't been reporting your earnings. My expertise is limited to Social Security benefits, though, so I don't actually know for sure whether or not you could qualify for . . . Read More
