Could I Draw Off Of My Husband's SSI Income After His Death?

I'm 40 and hoping to marry soon. The person whom I may be marrying will turn 60 in August. Nine months before I met him he was diagnosed with Parkinsons. After months of visits his Doctor determined him disabled, but still in his right state of mind to make decision. He now gets a disability and SSI monthly income. He only has one living Daughter (which has nothing to do with her Dad's Family and in her eyes no female is the right one for her dad). When he passes away (which I hope he out lives me), his Daughters plans are to take his remains to another town and plan a funeral . . . Read More

How Can I Find Out If Someone Has Successfully Filed Against My Social Security Number?

My Social Security number was compromised according to my Credit Report.. How can I find out if anyone has successfully filed against my SS number

Hi,

It's extremely unlikely that someone would have used your Social Security number to apply for Social Security benefits, but the only way that you could find out for sure is to call or visit a Social Security office.

Best, Jerry

Hi,

I'm sorry for your loss.

Assuming that you are at least full retirement age (FRA), your total benefit rate would likely be equal to your husband's full rate. Medicare would still need to be deducted from that amount, though, so you would likely be paid roughly the net amount that . . . Read More

Why Was I Not Allowed To Take Social Security Off Of My Ex-Husband?

Hi! I went into the Social Security office in April 2015 at age 63. I specifically asked the representative if I could collect off of my ex-spouses SS since we had been married over 10 years. She told me that because he was on SS disability I did not qualify to receive any monies from his SS. I ended up having to take an early retirement because of health issues and 3 years later was SS disability for myself. Why was I not allowed to take SS off of my ex husband since he had been injured during our marriage and cost me a lot of money to get him on disability due to his injuries . . . Read More

How Can My Wife Maximize Her Amount?

Hi Larry, I'm 66 FRA and will continue to work a year or so . My wife is 63 ( 66.6 is her FRA) she wants to retire and collect SS
I'm thinking to collect and still work. How can she maximize her amount. Should collect first or do I.

Hi,

Your and your wife's best filing strategy depends on a number of different factors, such as your birthdates and your relative benefit rates. For example, if you were born prior to January 2 1954, you may be able to collect benefits as a spouse while allowing your own benefit rate to grow until age 70. But, you . . . Read More

Does Medicare Recognize Coverage Under A Domestic Partner's Insurance?

I am under 65 and on disability. I have part A and B original Medicare. I also am covered under my boyfriend health insurance as a domestic partner (have been for years). His insurance is primary as thousands of employees and Medicare also in has verified this every year.

Medicare has my group health insurance information (though it been sitting in pending status this year compared to previous years).

Medicare in the past has paid secondary (which is correct..no issue with this). I had surgery last month and then Medicare told me that they do not recognize - . . . Read More

Can My Wife Start Drawing Her Benefits Even If I'm Still Working?

I am a lawyer, age 63 and plan on working until age 70. My wife just turned 67 and is entitled to her full retirement age benefits. Can she begin receiving them if i am still working, have not filed, and will not do so until 2027. I understand that she cannot receive spousal benefits until I retire, right?

Hi,

Yes, your wife is free to apply for her own Social Security retirement benefits whenever she so chooses. Your age and how much you're earning would have no effect on your wife's ability to collect her own Social Security benefits. But, . . . Read More

Should I Question My Survivor Benefit Rate?

I applied for widows benefits (divorced) at age 60. My ex-husband of 18 yrs died 5 yrs ago at age 58, never collected benefits. I was told I would receive $1530. a month. However, I received 5 months back payment (SSA is back-logged, I was told) for $6826. That comes out to $1374 a month. Why would I receive the reduced rate? That's $156. less than I was told. I just received a letter from SSA stating my benefits will be $1374. Should I question this, or pursue it with them, or just take the reduced payment? Thank you.

I have no way of knowing if . . . Read More

Is It True That I Can Only Claim Either My Own Benefits Or Spousal Benefits?

I applied for SS benes 12/2019. I received a letter 12/24/2019 telling me to call a SS agent before 12/31. I called on 12/30 and got a message that the agent wouldn't be back until January 2020. There was no option to leave a message. I called SS and they didn't know anything about it, told me to make an appt. I got an appt. for 3/12/20. I went to the office twice, once waited 3 hrs, left starving, another on 02/19/20 and filled out Statement of Claimant or other Person. I waited 3 weeks for a letter I was to get, nothing. I went today 3/12 and the agent told me that I could . . . Read More
