Can an ex spouse decline her portion off ex husbands benefit

Hi. The answer is basically yes. No one is required to apply for Social Security benefits, so an ex-spouse can simply choose not to apply for benefits. Or, if they've already applied, they could either withdraw their application or waive receiving benefits.

First of all, if your ex-spouse is still living and if you were born after January 1 1954, then you could never apply for divorced spousal benefits without being forced to claim your own Social Security retirement benefits at the same time. Therefore, assuming that your ex is living, then no you couldn't draw divorced spousal benefits at age 62 and switch to your own benefits at age 67.

I am 57 divorcing my 70 year old spouse. We have a 13 year old son. I am receiving a child in care spouse annuity . Child lives with me. I understand he will receive 50% of father’s PIA when divorce is final. I may receive 30% of husbands PIA right. (50% + 30% = 80% of family maximum) which families can get 180% right. My 30% will stop when child turns 16, right? Child’s continues until May of 2008 because he graduates high school. He turns 18 in October 2007. I turn age 62 in February of 2008 so now I qualify for divorced ss benefits.

I have Divorced Spousal Social Security from the U.S. I may qualify for a minimal pension in Belgium of about $100.00 monthly. I do not know if I would be paid from the beginning date April 2020 should I qualify.
How would my Divorced Spousal Social Security be affected?

I have not yet applied for SS, but I am at full age to do it. I may wait. My ex-spouse (married over 10 years) gets ONLY a government pension that he's collecting, even though he has worked jobs that he paid into SS. In my divorce settlement I was awarded a certain percentage of that pension that I have been getting for years and will continue to get. My question is, can I check if his SS is better than mine so I can make a better decision when I apply? Does the pension I get (awarded) from him have anything to do with my eligibility for my SS?

I was told on a previous call with ssi that I would qualify for divorced spousal benefits because my spouse's benefits would be greater than mine. A telephone appointment to sign up was made. A very rude employee told me on that call that I did not qualify and never would because my benefit would not be less than 50% of my spouses. I have read the entire publication on divorced spousal benefits and nowhere did I read that you would only qualify if your benefit was less than half of your spouse’s, only that it needed to be less than the ex-spouses benefit. Which is true?

I'm divorced after being married for more than ten years. I plan on filing for social security spousal benefits because my own benefit would be less than half of my former spouse's. But if I file at 67 (my age to qualify for full benefits) my former spouse will only be 65. Would I still receive half of his full social security amount, or would it be reduced because he hasn't reached full retirement age? Should I wait until I'm 69 and he is 67? Thank you!
