Divorced Spousal Benefits

Will My Spouse Lose Her Spousal Benefits If We Divorce Now?

Dear Larry,
I have a question I hope you can answer. I married about 4 years ago. My spouse and I reached our FRA in late 2020 and I filed for SS based on my record. My spouse filed for spousal benefits on my record. My question is, will my spouse lose her spousal benefits if we get a divorce now? Does the 10-year rule apply if you're already collecting spousal benefits when you get divorced? Thanks, Johnny

Do I Need To Wait Two Years To Apply For Ex-Spouse's Benefits?

I'm 65 years old and newly divorced after 18 years of marriage. My ex is also 65, and my PIA is less than half of his. Do I need to wait two years until I'm eligible to apply for ex-spouse benefits? If I apply for benefits now, will I only receive benefits based on my own wage history? If so, then when I become eligible for the divorced spousal benefit in two years when I'm 67, will SSA automatically increase my benefit to 50% of my ex's PIA, or do I need to apply for that?

Do I Qualify For An Additional Financial Benefit Due To Abuse And Violence Committed By My Ex-Spouse?

Hi Larry.

Can you please help me with your social security advuce? Below are details and questions.

My name is Deanne. I will be 65 years old on December 16th. I was born in 1957.

During my 25 years of marriage, I was physically and verbally abused by my husband at that time. He was arrested on 1 occasion, he went to jail, he went to court and was found guilty. I have a copy of the police report. I personally have over 40 credits on my own work record and qualify for social security. I have not taken my benefits on my work record yet.
