My girlfriend ex Husband are now divorce and Jayne and will not get married (remarried)
So does Jayne quails for 1/2 her ex now ScocialSecurity. When she decides to retire age 66 ( she is now 61. If he dies before she age retired 66. Is Jayne still qualify?
Hi. Jayne would need to be at least age 62 to potentially qualify for divorced spousal benefits, and her ex-spouse would need to either be a) drawing Social Security retirement or disability benefits, or he'd need to be at least age 62 and his divorce from Jayne would need to be final for at least 2 years.
When and if Jayne files for divorced spousal benefits, she'll be required to apply for her own benefits at the same time. She'll then only be eligible for essentially the higher of her own benefit rate or her spousal rate, and her benefit rate will be reduced for age if she starts drawing prior to her full retirement age of 67.
If Jayne's ex-spouse dies and if they were married for at least 10 years, she may be able to qualify for survivor benefits. Jayne may want to strongly consider using our software (https://maximizemysocialsecurity.com/purchase) to fully analyze all of her options in order to determine her best strategy for maximizing benefits.
Best, Jerry
