How Can A Person On SSDI Not Be Responsible To Repay A Debt?

If a person on SSDI acquires a debt (loan companies, verbal contracts with individuals) after being approved, how can he not be responsible to pay? I was going to take him to Small Claims court for money that he borrowed before and after being approved (his Dis. check used as collateral). The attorney said we will never get paid because he is "judgement proof". This person lived with us for 8 months after receiving benefits. I have irrefutable evidence that he filed a fraudulent claim i.e. He has never stopped working. I have submitted a fraudulent claim to OIG and have tried . . . Read More

How Does Social Security Calculate Hours For The Foreign Work Test?

Thank you for your answer Larry. There was one other question I had and forgot to ask you.
If I am under full retirement age and am collecting spousal social security I understand I can work in the US during this time with no clawback if my salary is less than $19,560 in the US. However if you are working in Canada it is 45 hours in a month. I am on a commission job (realtor) in Canada. Do you know how they calculate the 45 hours because my pay checks are not hourly. I would like to continue to work the max I can during this time but nobody has been able to tell me a . . . Read More

Will My CPP Cause A Deduction In My Spousal Benefit Due To WEP Or GPO?

I don't have 10 quarters of work in the US. I can qualify however for social security with my Canadian earned credits but taking spousal social security would be a greater amount so I do qualify for that.
My husband has worked in the US for over 30 years. Because I am collecting CPP will I be subject to a a deduction in my Spousal social security either under WEP or GPO.
Thank you
Karin

Hi Karin. No, your Canadian pension won't affect your spousal benefits from the U.S. Social Security program. The Windfall Elimination Provision (WEP) . . . Read More

Can I Collect Benefits Under My First Spouse?

I was a widow at a young age. I married another man for 7 years and divorced and now am currently married for 25 years. Can I collect survivors benefits under my first spouse? I am currently 63 in a week.
Thank you!

Hi. No, at least not at the present time. In order to qualify for widow's benefits you must either be a) unmarried, or b) married but your current marriage took place after you reached age 60. Therefore, since you are apparently married and your current marriage took place before you turned age 60, you couldn't currently qualify for . . . Read More

Was It Legally Required For Me To Apply For Benefits On My Father's Record?

I was on SSI 18-28. My dad retired in 2020 and I was switched to his retirement benefits. I was fortunate enough to never have any issues until the switch.

Was it really legally required for me to apply for these benefits? Even if I live on my own? Would it matter if we were estranged? And does retirement child benefits carry the same guidelines as SSI? Is there the same $2k asset limit? Or can I finally keep my meager savings in my bank account? (I have savings bonds given to me when I was an infant so I’ve always been close to the limit)

Thank you

If A Person's SSDI Benefits Stop Can They Choose To Take Early Retirement Benefits Temporarily And Then Switch Back To SSDI?

If a person is expecting to lose SSDI check (after TWP and grace period ) because of wages, can he or she choose to take early retirement benefits temporarily, but later switch back to disability benefits if earnings are reduced (below SGA) before person reaches Full Retirement Age?

Hi. If you're between age 62 and your full retirement age (FRA), then yes you could apply for reduced Social Security retirement benefits. But, whether or not you'd be able to 'switch back' to Social Security disability (SSDI) benefits depends on whether or not you're still in . . . Read More
