I am 59 and will qualify to collect my Ex-Husbands Soical Security, at 62. I have not re-married. Can I ever re-marry and keep drawing on his S.S., or marry before? Confusing! Thank you.
Hi,
You couldn't draw divorced spousal benefits on a living ex-spouse's record if you remarry, unless you marry someone who is receiving certain types of Social Security auxiliary or survivor benefits and you are already drawing your divorced spousal benefits at the time of your remarriage (https://secure.ssa.gov/apps10/poms.nsf/lnx/0300202045).
However, if your ex dies before you, then you could potentially qualify for surviving divorced spousal benefits even if you are remarried, provided that the remarriage occurred on or after your 60th birthday.
Best, Jerry
