When can I collect my X-husbands benefits. I'm on SSDI and will be 62. 08/02/2022. We were married over 10 years. I'd like to collect on his SS.
Hi. My answer assumes that your ex-husband is still living. In that event, you'll be old enough to claim divorced spousal benefits effective with the month you turn 62 (i.e. August). However, you'll only qualify for divorced spousal benefits if your primary insurance amount (PIA) is less than 50% of the amount of your ex's PIA. A person's PIA is equal to their Social Security retirement benefit rate if they start drawing their benefits at full retirement age (FRA), or their full Social Security disability (SSDI) benefit rate. Also, your ex-spouse will either need to be at least age 62, or drawing his Social Security retirement or disability benefits in order for you to be eligible for divorced spousal benefits.
Furthermore, if you do qualify for divorced spousal benefits and if you start drawing them prior to your FRA of 67, your divorced spousal amount will be reduced for age.
