I am on SSD and 55 Years old. They (SS) told me that my benefits automatically switch to SS at the age of 62. My ex-husband will only be 59 at that time. We were married for 23 years and divorced in 2015. When will I be able to claim spousal benefits on his record of employment?
Hi,
Your disability benefits (SSDI) won't switch to regular retirement benefits until you reach your full retirement age (FRA) of 67. You would have to be at least age 62 to qualify for divorced spousal benefits and unless your ex-husband becomes entitled to SSDI you couldn't be eligible at least until he turns age 62. Also, you would only be eligible for divorced spousal benefits if 50% of your ex-husband's full retirement age rate (PIA) is higher than your SSDI rate, and if you start drawing divorced spousal benefits before FRA your benefit rate will be reduced for age.
Best, Jerry
