Hello:
For me to get my retirement + ex spouse, one needs to be 10 years in marriage.
My question is 9 years and 10 months does not qualify? I guess I am really lucky?
Hi,
You must have been married for at least 10 full years in order to qualify for divorced spousal benefits. In some states and depending on the year of the divorce, however, a divorce decree is not final until some period of time after the date of the decree. You may want to check out the following summary of state laws on divorce dates from Social Security's operations manual: https://secure.ssa.gov/apps10/poms.nsf/lnx/0200305165.
Best, Jerry
