Will My Wife And I Be Subject To Any Clawbacks When We Claim Our Benefits?

Wife is Canadian and worked as a teacher in Canada for 10yrs. All numbers I have found says she qualifies for $80 a month in CPP and $500 a month from Ontario Teacher Pension. I am American and worked in Canada for 15 years and based on research should get $625 a month from CPP.

We have been back in the US for 15 years and I will qualify for max SS at full retirement of around $3100 a month. Wife did not work in the US. So she would only collect spousal at 50% once I retire.

Now to the question, are there any clawbacks to CPP or SS based on the other or can we . . . Read More

Are There Any Exceptions To The 10 Year Requirement For Divorced Spousal Benefits?

Married to ex spouse for 9 yrs 9 months. Grounds granted for divorce in the state of New Jersey, extreme physical cruelty. Are there any exceptions to the 10 yr. rule to collect his Social Security based on the circumstances?

Hi. No. You must have been married for at least 10 years to be able to qualify for divorced spousal benefits. The cause of the divorce is irrelevant (https://secure.ssa.gov/apps10/poms.nsf/lnx/0300202005).

Hi. No. The day of the month on which your benefit is paid is determined by the Social Security regulations and can't be voluntarily changed. The regulations that determine your payment date were established by Congress in 1997. Since that time, the only people who are paid their . . . Read More

Am I Eligible To Receive Benefits From My Ex-Husband's Social Security?

Hi Larry,
Am I eligible to receive benefits from my ex husband’s (married over ten years) benefits? I am not remarried and we have been divorced for 18 years. He is 65 (still working) and I am 57 (not working). If the answer is yes, when may I start receiving it?
Thanks in advance!

Hi. Maybe, but the earliest that you could qualify for divorced spousal benefits is at age 62, and if you start drawing benefits prior to your full retirement age (FRA) of 67 then your benefit rate will be reduced for age. And, as long as your ex-spouse is living the . . . Read More

Is My Grandson Eligible For Survivor Benefits?

My husband and I reconciled right before he got sick and passed away. I had sole custody of grandchild and adopted him after my husband passed away. Even when we weren't living together he helped support our grandson. But at the time of my husband's death we had been living together for 2 months. Is my grandson eligible for survivor benefits?

Hi. I'm sorry for your loss. I'm assuming that your grandchild is a minor child. If so, then based on your description it sounds like your grandchild would likely qualify for Social Security child benefits on your . . . Read More

How Do I Determine How My Child In Care Spousal Benefit Will Affect My Son's Benefit Amount?

My wife (age 62) is on SS, and our disabled adult son has just been approved for DAC/CDB benefits. I (age 65) will be filing a restricted application for Child-in-Care benefits and not applying for SS on my earnings history until age 70. I have used the SSA formula for calculating Family Benefit Maximum and am trying to determine how my CIC benefit will affect my son's benefit. Is this the correct formula to use: ( [Family Benefit Max] minus [my wife's benefit] ) divided by [# of auxiliary benefits which is two in this case for my disabled son's benefit and my CIC benefit]? . . . Is There A Family Cap On Benefits?

I have two sons who live with us that get social security disability. I am retiring soon and was wondering if there are any issues I should be aware of such as is there a family cap for social security or does anything in my social security affect the amounts they get? In other words, should I have a strategy that included their disability or should I just plan on taking to at 70 (which is my plan).
Thank you!
PS heard you on Money Life and bought your book!

Hi. There is no set limit on the total amount that can be paid to a family, but there is . . . Read More

What Do I Do If I Started An Application But Decided Not To Apply Now?

I started my application for benefits but would like to wait another year. I haven't submitted it yet but there is no way to let me cancel the application. It doesn't allow me to put in a later date than 5/22. It says if I do not submit it by 7/22 I could lose my benefits. What can I do?

Hi. For future reference, you aren't allowed to apply for benefits more than 4 months prior to the month you want to start your benefits. As for the application you started but didn't submit, after 6 months it will no longer be considered as a valid claim. That won't hurt . . . Read More

Should I Take SS At Age 62 If I Have COPD?

Should I take SS at 62 if I have COPD?

Is There Any Reason Why My Mother Didn't Receive Her Social Security Check This Month?

My mother has always received her social security (from my dad’s earnings - he is deceased) on the third. She receives assistance and is classified as a QI (qualifying individual). Today is the fourth and her check has not deposited? Any reason why? SHE IS VERY DISTRAUGHT- she is 81 and very worried). Your help is appreciated.

Hi. There's no way to know for sure without access to your mother's Social Security records, so I can only give you general information. Most people are now paid their benefits either on the 2nd, 3rd, or 4th Wednesday of the month . . . Read More
