How Long Must My New Wife Wait Before She Can Collect On My Benefits?

My new wife was collecting spousal benefits on her divorced husband we were recently married how long must she wait before she can collect on my benefits which are higher

Hi. If your new wife was collecting divorced spousal benefits in the month prior to the month of your marriage then she could potentially qualify for spousal benefits from your account as early as the first full month of your marriage (https://www.ssa.gov/OP_Home/handbook/handbook.03/handbook-0305.html). . . . When My Son Turns 18 Will I Get His Portion Of The Money?

I currently receive SSDI when my son turns 18 will I get his portion of the money or will I stay the same

Hi. No, when your son stops drawing his benefits it won't cause any change to your benefit rate. Spousal and child benefits paid to family members from a retired or disabled worker's record are auxiliary, or extra, benefits. They're paid in addition to the worker's benefit amount, not taken away from it. Therefore, since your son's benefits didn't cause your benefit rate to be reduced in the first place, your benefit rate won't go up when his benefit . . . Read More

Where On Social Security's Website Does Explain How Monthly Earnings Are Counted?

Larry: "When calculating a person's countable earnings for purposes of the trial work period (TWP) and substantial gainful activity (SGA), Social Security goes by the amount a person earns in a month, not the amount they are paid. However, Social Security will default to using the amount paid in a month unless they have evidence needed to show how much the person actually earned in the month"
Can you please tell me where it states this on the Soc. Sec. Website?

Hi. Those rules are explained in section DI 10505.005.C.1 of Social Security's operations . . . Read More

Can I Still Collect My Deceased Mother's Funds From Her Retirement Account?

Hello, my mother died about 30 years ago at the age of 52. I was 24 years old and did not know anything about collecting her social security funds. She had worked about 25 years at ATT and had money coming to her. I am asking now, can I still collect her funds from her retirement account? She was not married to my dad the 10 years required so I thought the kids get her funds, but I could be wrong.

Hello again, I am 56 years old and would like to retire at 62. I know I do not get the full amount of money at that time but a percentage of it. I am wondering if I can . . . Read More

What Do I Do?

I get SSI since I'm disabled. So what do I do? I barely survive with so little income after playing my bills. By 15th of each month I'm always in the red just trying to keep my head out of the water. I need your advice or help in this situation.
Thank you

Hi. I wish I had a good answer for you, but my expertise is limited to Social Security benefits. Supplemental Security Income (SSI) is the needs based program administered by Social Security, and apparently you're already receiving those benefits. It sounds like you might want to try searching the . . . Read More

How Do I Get My Medicare Premiums Refunded?

I got approved for Medicare part B be paid by the state of Missouri in July 2021and my premium is also still being taken out of my SSDI check every month. How do I get my premium refunded back to me?

Hi. Withholding of your Part B Medicare premiums should stop automatically once the state starts paying your premiums, and any refund due should also then be paid to you. When a state pays for a person's Medicare premiums, those payments are made by coordinating your state's computer system and Social Security's computer system. I don't know what the status . . . Is It True That If I Apply For Divorced Widow's Benefits Social Security Will Pay Me The Higher Of That Benefit Or My Own Benefit?

Hi Larry! Couple questions:
1. I am 63 years old and would like to start withdrawing my ‘divorced widow benefits’ now, even if my personal benefits at this time are slightly higher than my divorced widow benefits. .
I would like my own benefits to grow till my age of 70 and then switch to my own benefits at 70 when they will be even higher (and higher than my widow FRA).

I am told that once I apply, Social security will pay me whichever benefit is higher even if I specifically apply for the lower divorced widow benefit at this time.. is that true? What would . . . Read More

Should We File For Benefits?

MY spouse is now receiving SSDI benefits of 2887 month, we have an adult disabled child who collects ssdi benefits on his own record earning 1134 a month ( unable to engage in sga) who lives with us and whom I care for. I have never been employed. MFB is around 4330 a month. SSA suggested he apply on fathers record since he would be paid the higher amount, but when I apply as parent caring for disabled child benefits the disabled child already getting benefits on their own record would be reduced if MFB is split with me. Should we file for benefits for parents record?

Why Do We Need To Report Pensions To Social Security?

This year's Social Security Benefit letter indicates that if we receive pension for work in which we did not pay Social Security taxes, we have to let the know.

Pension does not have to pay Social Security tax, why we have to report to them?

Hi. Pensions based on a person's earnings that were exempt from Social Security taxes can cause a person's Social Security benefit rate to be reduced. That's due to the Windfall Elimination Provision (WEP), and the Government Pension Offset (GPO) provision. For more information on these provisions, refer to the . . . Read More

Will My Payment Still Come On The Third Of The Month?

I'm 66 my retirement check will it still come on the third of the month

Hi. I have no way of knowing whether or not your payment date will change, but I can tell you that the Social Security regulations that determine when a person is paid haven't changed since 1997.

Based on the regulations passed into law by Congress, the only people who should be receiving their payments on the 3rd day of the month are a) people who applied for benefits prior to April 30 1997, or b) people who also receive Supplemental Security Income (SSI) payments, or c) people . . .
