Is It Possible For My SSDI Rate To Increase Because Of My Earnings?

Hello, I was born and I am currently completely blind. If it is pertinent I also have two children 14 and 17 who are also completely blind and they receive Supplemental security because my current SSDI is not large enough for them to receive it off mine and I don't believe my husbands intermittent earnings records are large enough either. I started receiving my own SSDI at age of 24 in 1998, at which time I received basically minimum possible SSDI. Between In 1998 and 2000 I started a small part time job and because of this I received a small increase in the SSDI I was . . . Read More

If I Remarry May I Continue Drawing Half Of My Ex-Spouse's Social Security Benefits?

I am 66 and divorced after 13 years of marriage. If I remarry a foreigner who has never worked in the US, may I continue drawing half of my ex-spouse’s social security benefits?

Hi,

The answer is no, assuming that your new spouse isn't drawing U.S. Social Security widow(er)'s, mother's, father's, disabled adult child's, divorced spouse's, or parents benefits. Otherwise, divorced spousal benefit entitlement terminates effective with the month of a person's remarriage. However, divorced spouses can be entitled to survivor benefits on the record of a . . . What Happens If A Non-Covered Pension Is Reported Late And WEP Wasn't Applied Timely?

If non covered pension was reported several years after the fact, and WEP was not applied, how to back-date the guarantee WEP, calculate the debt and a new value of SS benefits?

Thank you for answering

Hi,

I'm not sure if I understand exactly what you're asking, but if Social Security doesn't receive notice of a non-covered pension until several years after the pension started they could go back and retroactively apply any resulting benefit reduction required by the Windfall Elimination Provision (WEP). WEP can cause a person's Social Security . . . Read More

How Should I Pay In The Social Security And Medicare Taxes I Owe?

I am a school teacher. Our payroll system changed mid year 2019. At that time due to a program issue no Social Security or Medicare taxes were withheld. How should I pay in the amount due? If on my tax return what form do I use? All that I have found do not seem appropriate for my situation?

Hi,

If you're an employee, then it's your employer's responsibility to withhold and pay any required Social Security and Medicare taxes. If your employer failed to withhold the appropriate taxes from your pay, then it would up to them to resolve the issue and . . . Read More

Can Long Term Disability Demand Back Pay For Recently Awarded SSDI Dependent Benefits?

Can long term disability demand back pay for recently awarded SSDI dependent benefits if no extra payment was made in monthly LTD pay for the children? My SSDI award is less than my LTD policy, and LTD is claiming they are owed child benefits in back pay and will reduce their future payment by counting child benefits.

Hi,

My only area of expertise is Social Security benefits, so I'm unable to answer your question. All I can tell you is that assuming your LTD payments aren't workers compensation or a public disability benefit ( . . . Read More

Will My Sister Be Entitled To The $1200 Stimulus Check?

My sister has a mental disability and lives in a group home in New York City. She receives both SSI and Social Security, and both payments are received and managed by a representative payee in the home where she lives. I don't know if her checks are automatically deposited in an account or sent as a check. Will she be entitled to the $1200 COVID 19 stimulus check? If yes, what will be the responsibility of the representative payee to make sure she gets the stimulus funds?

Hi,

I'm sorry, but my only area of expertise is Social Security benefits, so I'm . . . Read More

Do I Get My Husband's SS Payment If He Passes First?

I am 69 and have not filed for SS. My husband is 73 and has a fairly decent SS payment. If I file for SS do I get my husband's SS payment if he passes first. My monthly payment calculated was 250.00. a month. I pay 144.00 to Medicare. Which doesn't leave much for me to live on. I could probably live in a cardboard box under a bridge if I can't get my husband's SS if he passes first!! What can I do.
Janet

Hi Janet,

It certainly sounds like you'd qualify for your husband's full benefit rate as a widow in the event of his death, but without . . . Read More

Do I Need To Report My Mother's Death To Social Security?

I've been on SSDI for over 25 years for a mental condition. I receive 2 checks, 1 Disability check and 1 Survivors check. I lived with my Mother for all this time in her house. She died in March. Do I have to report her death to social security? I have to move soon. Do I need to report to social security when I move? Will the amounts of the checks I receive be the same or less when I move? Thanks.

Hi,

I'm sorry for your loss.

You'd only need to report your mother's death to Social Security if she was receiving benefits from them. Moving to a . . . Read More
