Hi. You must have been married for a minimum of 10 years to be able to qualify for divorced spousal benefits. However, if your ex is deceased and if you have a child in your care who is either under age 16 or disabled, then you may be able to qualify for surviving divorced mother's benefits if your child qualifies for child's benefits on your ex's Social Security record.

Why Wouldn't My Friend Qualify For Benefits From Her Ex-Husband's Social Security?

Hi Larry

I am asking this question for an elderly friend who is 78 years old. She has been divorced for many years. She has been collecting social security of her own record being 1200.00 per month. Too little to live on. Her ex husband made much more than her in their over 20 yr marriage. She has been told she does not qualify for her ex husbands social security. Why would she not qualify? and if she does how to go about it?

Is My Husband's Ex-Wife Eligible For A Benefit Equal To 50% Of My Husband's Benefit Rate?

My husband and his ex-wife were married 25 years. Following their divorce, at the age of 51, she remarried. Her second marriage lasted 30 years before her husband passed away. She is getting a widows benefit from the 2nd husband's SSA record. Half of my husband's social security is greater than the widows benefit she is getting, but SSA is saying she isn't eligible for it. I'm not confident they are always correct. Is she ineligible? As this is her only income, we would like for her to get as much as possible. Thank you.

I can't give you a specific answer without additional information about you and your ex-spouse. It sounds like you meet the duration of marriage requirement for divorced spousal benefits, but you would also need to meet the other requirements in order to actually be paid benefits. How Can I Make Sure That My Wife Can Collect 50% Of My Benefit If We Divorce?

I may be getting divorced in the near future and wanted to make sure my wife would be able to collect 50% of my present SS benefit which would be more than she gets now. My question is also as she collected her benefit at 62 ( so before FRA ) does that have any impact on the 50% amount? She will be 68/69 when we do divorce.
