What Rights Do I Have If My Request For Withdrawal Of My Application Isn't Approved?

Hi, I had applied for Ssi benefits about a week ago, and then decided I didn't want to go through process so, I sent in the request for withdrawal of application form ssa-521. If request in not approved , but denied what can I do? What are my rights?

Hi. If your withdrawal request is disallowed by Social Security you would have appeal rights. The full appeal process is described in the following Social Security publication: https://www.ssa.gov/pubs/EN-05-10058.pdf.

Is It Correct That My SSI Will Go Away When I Start Receiving Social Security Retirement Benefits?

I am on SSI, I get $794 a month. I am turning 62 in September, 2021 as I was born in 1959 so a couple months away! I want to apply for early retirement! I assume the SSI will go away at that point as I will receive approx. $1575 a month then? Is this correct? Also when I go to apply for retirement on the IRS website to I state that I am on SSI, Disabled or what?
I don't want to make any costly mistakes when I am filling out the retirement application!

Thank you,

David

Can I Get A Higher Disability Benefit From My Ex-Spouse's SS?

Im on ssd now and wonder if i could claim more ssd off my exhusbands(married 23yrs) ss now or do i have to wait for him to retire.

Hi. No. There is no such thing as a disabled spousal or disabled divorced spousal benefit. The only way that you could possibly qualify for a disability benefit based on your ex-husband's account is if he's deceased and if you are at least age 50.

You may be able to qualify for regular divorced spousal benefits based on age, though, but only if you're at least age 62 and if your ex-husband's primary insurance amount ( . . . Read More

Why Do I Have To Wait Until Age 60 For Spousal Benefits?

Why do I have to wait for spousal benefits until I'm 60 yrs. old. I have no income and don't understand the waiting period. Thank you

Hi. Actually, the earliest that you can potentially qualify for spousal benefits on the record of a living spouse is at age 62, unless you have a child in your care who's eligible for child benefits (https://www.ssa.gov/OP_Home/handbook/handbook.03/handbook-0305.html). You can potentially qualify for survivor benefits on a deceased spouse's . . . Read More

Will The Fact That My Husband Drew Disability Benefits Affect My Survivor Benefits?

Hello; My husband was receiving ss disability for 6 years before his death at age 64 with a benefit of $2480 per month before taxes. I am 58 years old and understand I cannot get survivor benefits until age 60 and then at a reduced rate. I will probably begin them at age 60 as I will need that income. Will his being on disability affect my survivor benefits? Also will his benefit amount increase after his death as I have another 16 months after his death before I can claim his benefits. Is there a better strategy you can see for my situation? I have a work history but no where . . . Read More

Will My Benefits Automatically Switch To My Full Benefit Amount When I Reach Age 70?

I have been receiving 1/2 of my ex spouse's social security benefits since I was age 65. I will be 70 in Nov. 2021. Will my social security automatically switch to my full social security amount; or do I need to file a document to make this happen?
Thanks,
Janet

Hi Janet. I assume you mean that you were born prior to January 2 1954, and you filed a restricted application for divorced spousal benefits only when you reached full retirement age (FRA). If so, you'll need to file a full application for Social Security retirement benefits in order to . . . Read More

Will My Benefit Rate Go Up After I Work Three More Years?

I have stopped disability and went back to work after 6 years. Will my SS benefits go up after working 3 more years?

Hi. I don't have enough information to be able to give you an answer. Social Security disability (SSDI) benefits can be calculated based on an average of as few as 2 years of a person's earnings or as many as 35 years of earnings depending upon their age at the time they became disabled. Subsequent earnings can only increase the person's benefit rate if the yearly earnings amounts are high enough to raise their average earnings in the years . . . Read More

I'm am currently recieving SSDI under my deceased husbands benefits. Approximately 2 years know. My husband Jim passed 4 years ago. question is: If I were to remarry would I lose my survivor's benefits? I've "heard" I have to be widowed a certain amount of years before I could remarry or I would lose them. TY Kathy

Hi Kathy. First off to clarify, Social Security disability (SSDI) benefits are only paid based on a disabled worker's own Social Security history. If you're receiving disability benefits based on your deceased husband's work history you must be . . . Read More
