Can My Mother-In-Law File For Spousal Benefits Now At Age 65 And Delay Her Own Benefits Until 70?
Hello Larry,
My mother-in-law is 65 and divorced, her ex husband is also 65. They were married for 30 years and she never remarried. Would she be able to file for spousal benefits now and delay her own benefits until 70? By collecting spousal benefits before her FRA will that reduce her benefit at age 70?
Thanks,
Casey
Hi Casey,
No. As long as your mother-in-law's ex-spouse is still living, she could never file just for divorced spousal benefits without also being deemed to be applying for her own benefits at the same time. Only . . . Read More

Can I Draw Social Security From My Spouse's Record?
I am 71 started Social Security at age 62. My husband is also retired at 71, he works parttime. Can I draw Social Security from his even though I get my own
Thank you
Hi,
You could only qualify for spousal benefits while your husband is living if 50% of his primary insurance amount (PIA) is higher than your own PIA. A person's PIA is equal to their Social Security retirement benefit rate if they start drawing their benefits at full retirement age (FRA). You don't mention your benefit rates so I have no idea whether or not you'd qualify for . . . Read More

Isn't It Unfair To My Spouse To Receive A Lower Spousal Rate Due To My Federal Pension?
Sir:
Just discovered your website! BRAVO -- it is AMAZING!
Background -- Me - Retired Federal Employee under CSRS. Wife -- stay at home mom. No Employment history.
Even though a Federal Employee -- I also worked for jobs covered by SS. 30 Years worth of earnings - though only 20 years of substantial earnings. So my SS benefits are reduced because of the WEP. I understand that. Ahhhh, but my spouse is penalized through no fault of her own vis-a-vis an equivalent spouse with no work history whose husband worked in an SS covered position. Your opinion -- I know . . . Read More

Does My Husband Have A Right To Any More Of My Payout?
I am 63 in 2020 and my soon to be ex will be 61. We do not plan to file for SS benefits until full retirement age. Our current SS benefit payouts show I will receive $2000/month and he will receive $1500/month. As I have read and tried to understand on the SS website, he may file for half of the difference between our payouts (so $250) which the government will take care of. Is that correct as of now? Do he have a right to any more of my payout?
Hi,
I think you must have misread something. Your husband/ex-husband couldn't qualify for spousal/divorced . . . Read More

Can My Husband Still Apply For Disability Benefits At Age 65?
Hi Larry,
I was born in December 1951 and my current husband was born in August 1955. I retired in 2017 and started SS on my deceased ex-husbands record. My current husband who is working became permanently legally blind in 2017. At that time we filed for Social Security Disability for him but later withdrew the application as my husband wanted to continue working. His work bought special equipment for him. As time as gone on he has been given less and less work to do and has decided to retire in January 2021. He will be 65 at that time. Is he still able to apply based . . . Read More

How Do I Find Out What I'm Entitled To?
How do I find out what I'm untitled to?
My income per mo.is $550.00 SSI disability and
$250.00 of my exhusbands SS. Friends in
my position receive much more. I don't
Understand.
Hi,
I can give you a general explanation. Social Security benefit rates are calculated based on the average annual Social Security covered earnings level of the person on whose record the benefits are paid. The higher the average earnings, the higher the benefit rates. The number of years used in the calculation depends on the type of benefit . . . Read More

When Can I File For Spousal Benefits?
Hello, first thank you for your time! I have read many things about SS benefits but I'm still confused. I am currently still married but do not live with my spouse. I guess you can say we are separated (Not Legally) but have not been together in over a decade. We also live in 2 different states. He filed for SS after he was 62. He's 65 now and I'm 5 years younger. So I am 60 now. When can I file for spousal benefits? I do not want to file for mine until I am 67 to get full benefits. I'm not sure who has made more in their life time and I'm not sure how you requested spousal . . . Read More

When Should I Apply To Begin Receiving My Maximum Benefits?
I turn 70 years old 2021 on June 23rd. I want to start taking my Social Security on July 1st of 2021. When should I apply to SS to begin receiving my maximum benefits?
Hi,
You can submit your application up to 4 months prior to the month that you want to claim your benefits, but it sounds like you would want to claim benefits effective with June 2021, not July. Social Security considers you to be age 70 for the entire month in which you reach that age, so if you turn 70 on June 23 2021 you'll be eligible for your full age 70 rate if you claim . . .
