Will My Boyfriend Be Liable For My Social Security Overpayment If We Get Married?

About 10 years ago, I appealed an overpayment and asked for a hearing. I was in grad school at the time and the funding I got as a Teaching Assistant was misapplied as earnings. The TA-ship is a form of financial aid. I never heard back from Social Security and am no longer on disability. My boyfriend and I want to get married. Will he be held liable for any of these overpayment if Social Security gets around to reviewing my case?

I've been afraid to call and ask them directly because I am unemployed and they claim I owe them a substantial amount. Thanks.

Hi. I'm sorry, but my expertise is limited to Social Security benefits. I don't know what your options are with regard to drawing a pension from your former employer.

With regard to your Social Security disability (SSDI) benefits, drawing a pension from your former employer wouldn't . . . Read More

Is It Correct That I'll Continue To Receive Both My Own SS And My Widow's Benefit When I Turn 65?

Larry,
Currently I am 61, and started receiving SSDI 2 years ago. My husband was killed on the job in 1990. At age 60 I started receiving what SS calls excess widows benefits.
I have been told by SS that my disability will automatically convert to SS when I turn 65, and I will continue to receive both my SS, and my widow benefits. Is this correct or have I been miss-informed…repeatedly?
Thank you,
Nora

Hi Nora. Nothing will change when you reach age 65, but when you reach your full retirement age (FRA) of 67 your Social Security . . . Read More

If My Wife Applies For Benefits At Age 62 Can She Get The Higher Of Her Own Benefit Or 50% Of My Benefit Amount?

I am currently 62 and I am looking to file for my Soc Sec benefits when I turn 63 (my FRA is 67). My spouse (59 at this time) has paying into SSA and is eligible for benefits on her own right. My question is, when she turns 62, can she get the higher of either her own benefits or the 50% of the amount that I am eligible for when I file? Will she get 50% of my payout when I file (well before FRA) or will she get less than 50%? Thank you!

Hi. If you're already collecting your benefits when your wife files for benefits, then she would end up receiving . . . Read More

Why Isn't My Full Self-Employment Net Income Shown On My Social Security Earnings Record?

Why is the lesser amount on my SE Tax form of my returns reported to SS for my "benefit income"?
Ex. I am self employed, my net income is $53,660, which gets transferred to the SE Tax form to calculate what I owe for that, and yet the SS benefits website is reporting the LESSER number on that form to calculate my benefits, so they're picking up the $49,555, not the net income of $53,660. Why?

Hi. The lower amount, which should be 92.35% of your net self employment earnings, is the amount on which you actually pay Social Security taxes ( . . . Read More

What Kind Of Health Insurance Can I Get If Social Security Cuts Off My SSDI Benefits?

I'm 62. In 2018 went on FMLA then Long Term Disability from prior employer then to SSDI awarded October 2020. I was diagnosed with Small Cell Lung Cancer treated with Chemo and Radiation but right lung tumor has shown increase recurrance or relapse not sure the correct terminology. I got a letter from SSDI asking about any work done since April 2018 which is zero due to the cancer(s) and the treatment along with mental health issues and other medical issues and the recent possibility of breast cancer. Should Social Security Recalculate My Benefit Rate If I Earn More Than I Did In One Of My Previous Highest 35 Years Of Earnings?

Hi,

I have a question regarding working after reaching FRA while collecting social security benefits regarding whether benefits increase due to higher current earnings than in the 35 best years used to calculate benefits in 2020.

I now have total of 45 years of earnings because I still work part-time. I started collecting social security in 2020 at the age of 67+ (my FRA was 66 yrs. born 1953), and my 35 best earning years were used to determine my benefits. In the last 2 years, I have earned part time more each year than my bottom years of the 35 best earnings . . . Read More

Is It Correct That My Wife Can't Apply For Spousal Benefits And Wait Until Age 70 To Claim Her Own Benefits?

I turn 70 next year and will then take social security. My wife will turn 67 next year. I had thought that she could first apply for her spousal benefit (about 50% of what I was eligible at age 67) and then when she turns 70, apply for her own benefit. I am now being informed that I'm incorrect. Since she was born after 1954, she has only one bite at the social security apple. Take her spousal benefit or wait until she turns 70. Is that correct?

Hi. Yes. Only people born prior to January 2 1954 are allowed to apply just for spousal benefits at full . . . Read More

Would I Get Back Pay If Social Security Incorrectly Suspends My Benefits Due To An Overpayment?

If I'm suspended for over payment, and SSD says I should have never been suspended, willing get back pay?

Hi. Yes, if Social Security withholds benefits to recover an overpayment and later determines that there was no overpayment, they would refund any benefits due that were withheld.

Best, Jerry
