Disability Benefits

Can I Do Anything To Get Back Pay Or Is It Too Late?

I filed for disability in Georgia. My lawyer was Blake Tiller, he became a state senator during my case. I was a truck driver, I passed out, automatically lost my CDL license for a year , so I filed short term Disability with my company. Me and my husband were contract driver for the DOD, RAM loads , and energy . We hauled anything the government needed., Mostly for Military. I passed out on 1/29/15, went to see neurologist, which I have been seeing, and told her I passed out 2 times. She started running test. Would not sign off for me to drive a Rig again.

Shouldn't We Have Received A New Award Letter With Back Pay?

Hi Larry, My husband has stage 4 colon cancer, he was diagnosed in Oct 2019 , he didn't apply for SSDI until Oct 2020, he worked 2019 until Dec, and only 2 months in 2020.
He applied online and was contacted by the local field office , he had more forms to fill out. he did so on the phone with the rep.
CT sends the medical determination to Boston, a rep from there then sent more forms for him to fill out, he sent them.

Does My Husband Have To Be Out Of Work Before He Can File For SSDI?

My husband is 60, was diagnosed with Parkinson's in 2019, He is under the care of a neurologist and is on medication and does have a significant tremor in his hand. He is a construction superintendent. He is still independent and can do everything for himself - feed, dress, bathe, but we've noticed he is not physically as strong as he was a year ago and his decision making and problem solving is impaired sometimes, his walking is not always steady which can be dangerous especially on a construction job site. He has worked since he was a teenager.

Can You File For Social Security Disability If You Already Receive Early Social Security Benefits?

Can you file for social security disability if your already receiving an early social security benefit.

Hi. Yes. As long as it would be possible for you to qualify for Social Security disability (SSDI) benefits prior to your full retirement age (FRA), you can apply for SSDI benefits. However, if you do qualify for SSDI benefits you can't be paid both SSDI and regular Social Security retirement benefits at the same time. You can only be paid up to the higher of the 2 benefit rates.

Is It True That Social Security Considers You To Be 'Working' If You Place Orders For Stocks And Cryptocurrency?

Hi Larry,
My Mother has been receiving SSDI benefits since 2017. She is a member of a social media group that frequently answers questions related to disability. My question is related to investing. She opened an online trading account and bought some stocks and cryptocurrency. The group answered someone else's question about this same scenario and the moderator told them it would be considered "working" if you placed the trades yourself. I have been unable to find anything stating this information online, only that it is okay to invest. Can you advise?

Is It Possible To Withdraw My SSDI If I've Been Collecting Benefits For Two And A Half Years?

I'm going to do a withdrawal on my SSDI but I've been collecting for last two and a half years is that possible? Total money I got from them was $3,400. I know I will have to return that in full

Hi,

Yes, it's possible to withdraw a claim for Social Security disability (SSDI) benefits provided that you refund all of the benefits you've received. Unlike withdrawing a claim for Social Security retirement benefits, there is no set time limit on when your request for withdrawal of a claim for SSDI benefits must be filed.

Is It Legal For Me To Collect Unemployment Benefits If I'm Receiving SSDI?

Hi Larry, I am collecting SSDI for many years and have worked part time, Last March I was laid off from my part time job (making under $1100 a month) and applied for unemployment , I started collecting soon after but am not sure If its legal or not. I am in California.

Hi,

My only area of expertise is Social Security benefits, so that's the only part of your question that I can address. All that I can tell you is that collecting unemployment benefits has no effect on Social Security disability (SSDI) benefits.

What Should We Do?

I am 53 , my husband is 61 he has brain cancer stage 4. We have 2 daughters 12 and 14
I am being advised to ask for his social security special condition. He is terminal and not suppose to last 1 year.
I was also told that this will reduce my children payment and widow payment.
I worry about losing our house. I work for home, but I have had to stop working to take care of him.
I need to be able to pay for healthcare. we have still about 8 months left of saving. He was diagnosed this summer
I do no know what to do.
